1. Subject to General Terms and Conditions
1.1 The company offers services related to web design, programming, web project support and mobile application development.
1.2 These terms and conditions are intended to govern the relationship between the Company and the Customer in the provision of these services.
2. Definitions
2.1 "Company" means OnMedia Ltd.
2.2 "Customer" means any natural or legal person who enters into a contract with the Company for the provision of services.
2.3 "Services" include all activities related to web design, software development, web project support and mobile applications.
2.4 "Product" means any website, mobile application or other development carried out by the Company for the Customer.
2.5 "License" refers to the right to use the Software created by the Company in accordance with the terms of the Agreement.
3. Rights and obligations of the parties
3.1 The Company undertakes to provide high quality services in accordance with the Client's agreed requirements.
3.2 The Company is responsible for the technical performance of the products created for the Customer within the agreed terms and conditions.
3.3 The Customer undertakes to provide accurate and timely information necessary for the performance of the Services.
3.4 The Customer is responsible for the proper use of the products and services provided by the Company.
4. Prices and payments
4.1 Prices for products and services shall be agreed individually between the Company and the Customer and confirmed in writing in the relevant contract or quotation.
4.2 All payments shall be made in accordance with the agreed terms and conditions.
5. Restrictions and prohibitions
5.1 The Customer shall not distribute, resell or modify the products developed by the Company without express permission.
5.2 The Customer is not permitted to use the Company's services for illegal purposes or to infringe the rights of third parties.
6. Guarantees and responsibilities
6.1 The Company warrants the technical serviceability of the Products for the period agreed in the relevant contract.
6.2 The Company shall not be liable for any damages resulting from improper use of the Products by the Customer.
6.3 In the event of problems with the services provided, the Company undertakes to make the necessary corrections within a reasonable time.
7. Termination of contract
7.1 The Contract may be terminated in the event of default by either party.
7.2 The Company shall have the right to terminate the Contract unilaterally if the Customer fails to comply with the agreed terms or fails to make timely payment.
7.3 The Customer shall be entitled to terminate the Contract if the Company fails to perform its obligations within a reasonable time.
8. Privacy and data protection
8.1 The Company undertakes to collect, store and process the Customer's personal data in accordance with applicable law, including the General Data Protection Regulation (GDPR).
8.2 The Customer's personal data will only be used for the purpose of performing the Services and will not be provided to any third party without express consent.
9. Term and entry into force
9.1 The General Terms and Conditions shall come into force from the date of conclusion of the contract between the Company and the Customer and shall be valid until the expiry of the agreed term or until termination of the contract.
10. Amendment of General Terms and Conditions
10.1 The Company reserves the right to change these Terms and Conditions. Any amendments will be notified to the Customer and will become effective upon acceptance by both parties.
11. Dispute Resolution
11.1 Any disputes arising between the Company and the Customer in connection with the provision of the Services will be resolved by negotiation between the parties.
11.2 If no agreement can be reached, disputes will be settled by court proceedings in accordance with the laws of the Republic of Bulgaria.
12. Force majeure circumstances
12.1 The Company shall not be liable for non-performance of obligations if this is due to force majeure, such as natural disasters, war, strikes, or other events beyond the Company's control.
13. Applicable law
13.1 These General Terms and Conditions and all contracts entered into between the Company and the Customer shall be governed by the laws of the Republic of Bulgaria.
These Terms and Conditions are designed to provide transparency and clarity in the relationship between OnMedia Ltd. and its customers.
